1.1 EZ Drive Australia (“we”, “us”, “our”) provides professional driving lessons, learner driver education, mock driving tests, and VicRoads drive test preparation services in Victoria.
1.2 These Terms & Conditions apply to:
⦁ Any person who undertakes driving lessons with EZ Drive Australia; and
⦁ Any person or entity who books or pays for lessons on behalf of another person
1.3 By accessing our website https://ezdrive.au, booking lessons, making payment, or participating in any Service, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.
1.4 If you do not agree to these Terms, you must not use our Website or Services. - Acceptance & Changes to Terms
2.1 You accept these Terms by:
⦁ Using or remaining on the Website;
⦁ Booking, paying for, or attending lessons; or
⦁ Allowing a minor under your care to participate in lessons.
2.2 We may update or amend these Terms from time to time. Updated Terms take effect immediately once published on the Website.
2.3 It is your responsibility to review the Terms regularly. - Registration, Bookings & Eligibility
3.1 To access Services, you may be required to provide personal information including:

3.4 We reserve the right to refuse, suspend, or cancel bookings if eligibility requirements are not met or if safety concerns arise. - Student Obligations
4.1 You agree to:
⦁ Follow all instructor directions at all times
⦁ Drive responsibly and lawfully
⦁ Treat instructors respectfully
⦁ Comply with road rules and safety instructions
4.2 You must not:
⦁ Provide false or misleading information
⦁ Attend lessons while unfit to drive
⦁ Interfere with the safety or operation of lessons
4.3 Breach of these obligations may result in immediate termination of lessons without refund. - Booking & Lesson Guidelines
5.1 All lessons are subject to instructor availability.
5.2 We aim to schedule lessons at times convenient to students, however lesson times cannot be guaranteed.
5.3 Students must be contactable by phone or text before each lesson. Instructors may contact you upon arrival.
5.4 You must bring the following to every lesson:
⦁ Valid learner permit or driver licence
⦁ Logbook (if applicable)
⦁ Corrective eyewear (if required by licence conditions)
5.5 Failure to bring required documents or items may result in:
⦁ Lesson postponement
⦁ Reduced lesson duration
⦁ Cancellation fees being applied - Payments
6.1 All lesson and drive test fees must be paid in full before commencement unless a prepaid package is in place.
6.2 Accepted payment methods include:
⦁ Electronic Funds Transfer (EFT)
⦁ Credit or debit card
⦁ Other approved payment methods
6.3 Prices are listed in Australian Dollars (AUD) and may change without notice.
6.4 Failed or unpaid payments may result in cancellation of Services and recovery of associated costs. - 🔁 Refund & Cancellation Policy

7.1 Lesson Cancellations & No-Shows
⦁ A minimum of 24 hours’ notice is required to cancel or reschedule lessons
⦁ Cancellations with less than 24 hours’ notice incur the full lesson fee
⦁ Failure to attend a lesson without notice (no-show) is non-refundable
Late arrival may reduce lesson time without refund.
7.2 Refunds
7.2.1 Refunds are not provided for change of mind.
7.2.2 Refunds may be considered only where:
⦁ EZ Drive Australia is unable to deliver the booked Service; or
⦁ Management determines exceptional circumstances apply
7.2.3 Approved refunds are processed using the original payment method.
7.3 Packages & Block Bookings
⦁ Lesson packages are non-transferable
⦁ Packages may only be used by the original purchaser
⦁ Packages expire 12 months from date of purchase unless stated otherwise
⦁ Unused lessons after expiry are forfeited and non-refundable
- Drive Test Requirements
8.1 On the day of a drive test, it is your responsibility to ensure you meet all VicRoads requirements, including:
⦁ Valid learner permit or licence
⦁ Completed logbook (if applicable)
⦁ Valid Hazard Perception Test
8.2 Drive test fees are non-refundable if cancelled due to:
⦁ Incorrect booking details
⦁ Failure to meet VicRoads requirements
⦁ Failing the driving test - Medical Fitness & Health Disclosure
9.1 You warrant that you are medically fit to drive.
9.2 You must notify EZ Drive Australia before lessons commence if you:
⦁ Take medication that may affect driving
⦁ Have a medical condition that may impair safe driving
This includes (but is not limited to):
⦁ Vision or hearing impairments
⦁ Neurological or heart conditions
⦁ Epilepsy, diabetes, dementia
⦁ Psychiatric or sleep disorders
9.3 Where required, you warrant that you have obtained medical clearance from VicRoads.
9.4 Failure to disclose medical conditions may result in immediate termination of lessons and refusal of service. - Drugs, Alcohol & Fitness to Drive
10.1 You warrant that you are free from alcohol, illicit drugs, and impairing substances during lessons and drive tests.
10.2 If impairment is suspected, the lesson will be terminated immediately without refund. - Vehicles, Insurance & Accidents
11.1 EZ Drive Australia vehicles are covered by full comprehensive insurance.
11.2 You will not be required to pay an insurance excess unless damage results from:
⦁ Wilful misconduct
⦁ Illegal activity
⦁ Reckless or dangerous behaviour
11.3 You must follow instructor directions in the event of an incident or accident. - Dash Cameras
12.1 Vehicles may be fitted with dash cameras.
12.2 Footage may be used for:
⦁ Safety monitoring
⦁ Instructor training
⦁ Quality assurance
⦁ Incident investigation
All footage is handled in accordance with privacy laws. - Traffic Offences
All fines, penalties, and demerit points incurred while you are driving during a lesson are your responsibility. - Social Media & Advertising
14.1 Instructors may request permission to take photos or videos during lessons or after successful test completion.
14.2 By agreeing to these Terms, you consent to EZ Drive Australia using such media for:
⦁ Marketing and advertising
⦁ Social media platforms
⦁ Website and training materials
14.3 Media may be edited for format and presentation but will not be used misleadingly.
14.4 You may opt out by notifying us in writing before lessons or tests. - Parent / Guardian Consent (Under 18 Years)
15.1 If the student is under 18 years of age, a parent or legal guardian must provide consent before Services commence.
15.2 By booking lessons for a minor, the parent/guardian confirms that:
⦁ They are the legal parent or guardian
⦁ The minor holds a valid learner permit
⦁ They have reviewed and accepted these Terms
15.3 The parent/guardian:
⦁ Consents to the minor participating in driving lessons
⦁ Accepts responsibility for ensuring compliance with these Terms
⦁ Acknowledges the inherent risks of learning to drive
15.4 EZ Drive Australia may rely on information provided by the parent/guardian regarding the minor’s medical fitness and eligibility. - Privacy
Personal information is collected, stored, and used in accordance with our Privacy Policy and Australian privacy laws. - Limitation of Liability
Nothing in these Terms limits rights under Australian Consumer Law.
To the extent permitted by law, our liability is limited to:
⦁ Re-supplying the Services; or
⦁ Refunding the amount paid for the affected Service - Indemnity
You agree to indemnify EZ Drive Australia against any loss, claim, or damage arising from:
⦁ Breach of these Terms
⦁ Failure to follow instructor directions
⦁ Breach of road laws - Termination
We may suspend or terminate Services immediately where:
⦁ These Terms are breached
⦁ Safety concerns arise
⦁ Required by law - Dispute Resolution
Disputes must first be addressed through good-faith negotiation, then mediation before court proceedings. - Governing Law & Jurisdiction
These Terms are governed by the laws of Victoria, Australia.
Victorian courts have exclusive jurisdiction. - Severance
If any provision is unenforceable, the remaining provisions continue in full force.
